Cultural Improvement Program, Scottsdale, Arizona, Zoning Ordinance, Appendix B, Article VII, Sec. 7.1000-1017 (2024).
The Code establishes that Planned Block Developments (PBDs), as defined by the ordinance, within the Downtown area are subject to a mandatory public art requirement worth no less than 1% of the building valuation. The developer may alternatively make an in lieu payment of equivalent value to the Downtown Cultural Trust. The following projects are excluded from the requirement:
- Interior Tenant improvements; and
- Alteration of a building for which a Cultural Improvement Program contribution was previously made.
- Residential uses in a PBD overlay district that was rezoned before January 1, 2013.
- Dwellings, single-family and two-family.
- Properties zoned “special campus,” in which Cultural Improvement Program elements have been included in the development plan.
