Art in Public and Private Developments, Apache Junction, Arizona, Municipal Code, Chapter 1, Article 1-13, Section 1-13-4 (2020).

The Code establishes that developers of projects with construction costs over fifty thousand dollars ($50,000.00) for new mixed-use or commercial buildings, or residential buildings with ten (10) dwelling units or more, or the expansions of such buildings must make a public art contribution. The public art contribution may be satisfied either as one percent (1%) of building construction costs up to one-hundred thousand dollars ($100,000.00) per building to be put toward acquisition and installation of public art; or contribute an equal amount to the Art in Public Places Fund.

Renovation exceeding fifty percent (50%) or more of the gross floor area of a mixed use and/or nonresidential building calculated based on the gross floor area of the entire building at the rate applicable to construction of the same type triggers the one percent (1%) contribution.

Projects which are under five thousand (5,000) square feet have a lower requirement of at least one-fourth of one percent (0.25%) of the project valuation. Projects which are between five thousand (5,000) square feet and ten thousand (10,000) square feet have a requirement of one-half of one percent (0.5%) of the project valuation.

Projects which are exempt from these requirements include:

• Industrial uses, communication facilities, utility installations and similar projects as determined by the Development Services Director;
• Federal, state, or county projects or structures;
• Residential uses other than multi-family;
• Public art expenditure not legally permissible due to the constraints imposed by the funding mechanism;
• Routine maintenance projects such as surface treatments; and
• Safety improvements such as sidewalks and overlays with shouldering for bike lanes.
