Public Art Requirement, Fountain Hills, Arizona, Zoning Ordinance, Chapter 19, Section 19.05 (I) (2025).

The Ordinance requires that all development projects shall be required to comply with the Percent for Public Art Requirement for Development, as dictated by the 2020 Public Art Master Plan.

The plan establishes that developers of any new professional office, lodging projects, retail, service, commercial, wholesale, transportation, industrial developments, re-developments or expansion projects, and multi-family projects with five or more dwelling units within the Town of Fountain Hills are required to provide on-site public artwork equal to up to one percent (1%) of the total construction cost of the project, or else make an equivalent donation to the Public art fund.

For projects one million dollars ($1,000,000.00) or less, contributions must equal one percent (1%) of the total construction cost. For projects with a value between one million dollars ($1,000,000.00) and ten million dollars ($10,000,000.00), contributions must equal three-quarters of one percent (0.75%) of the total construction cost. For projects with a value greater than ten million dollars ($10,000,000.00), contributions must equal one-half of one percent (0.5%) of the total construction cost.
