The Code establishes that private nonresidential and multi-family developments, including building additions and renovations, with construction costs in excess of five hundred thousand dollars ($500,000.00) are subject to a mandatory public art requirement. Developers can satisfy the public art requirement by paying a fee to the Building Department, valued at one half of one percent (0.5%) of the total construction costs. Remodeling, repair, or reconstruction of a structure damaged by fire, flooding, wind, earthquake, or other calamity is exempt from the requirement, as is any development owned or leased by a non-profit entity. As an alternative to paying the fee, developers can elect to create public art on-site. The value of the art installation will be credited against the fee requirement.
