The Code establishes that private, non-residential or mixed-use development projects with construction costs one million dollars ($1,000,000.00) or more are subject to a mandatory public art requirement. Exemptions to this requirement include temporary structures and residential construction. Projects which meet the above criteria must either contribute one percent (1%) of the construction costs to the Art Acquisition Fund, or provide public artwork on-site equal to three-quarters of one percent (0.75%) of the construction cost.

Artwork acquired by the city through the Art Acquisition Fund is maintained by the city via the fund. Artwork contributed by the developer on the project site must be maintained by the developer or property owner.
