The Code establishes that commercial, industrial, and multi-family private development or redevelopment  real estate projects which have construction permit valuation above two million dollars ($2,000,000.00) are required to expend at least two percent (2%) of the construction costs for the commissioning or acquisition of public art in or around the site, or else pay an in-lieu fee of one percent (1%) to the city for the acquisition of public art.

Projects exempt from this requirement include:

• single-family dwellings
• multi-family residential dwellings of four (4) or fewer units.
