Program Summary

The Code establishes that new developments with a value of two hundred thousand dollars ($200,000.00) or more; and the alteration or repair of a structure that increases total gross floor area, or otherwise intensifies use, with a value of two hundred thousand dollars ($200,000.00) or more are subject to a mandatory public art requirement. This includes residential developments with more than two (2) units but excludes affordable housing. Additional exceptions can be found in the code referenced above.

Projects may satisfy the requirement by installing public art on-site with a value of at least one percent (1%) of the project valuation. Maintenance and conservation of the artwork will be the responsibility of the site owner. If the developer wishes to include a large screen video sign as part of their development, they must comply with §19.34.080, Section H, which includes a requirement of thirteen (13) minutes of arts programming per hour as approved by the Fine Arts Commission. Alternatively, developers may contribute an in-lieu fee to the West Hollywood Public Art and Beautification Fund in an amount equivalent to one percent (1%) of the project valuation. If the valuation changes during construction, the fee shall be adjusted accordingly. The balance of the fee, if any, must be paid before issuance of a Certificate of Final Occupancy or Final Inspection.
