The Code establishes that developers in the Nine Rails Creative District are subject to a mandatory public art requirement if they develop one of the following:

• A new multi-family or group dwelling project, or an addition to an existing project that adds two (2) or more dwelling units; or
• A new non-residential building of two thousand (2,000) square feet or more, or an addition to an existing building that adds two thousand (2,000) square feet or more.

Developers can satisfy the public art requirement by placing public art on-site or on public property within the Nine Rails Creative District, subject to approval by the City. The value of the public art contribution shall be equal to one percent (1%) of the project’s building valuation. Alternatively, developers may pay an in-lieu fee equal to one percent (1%) of the project’s building valuation to an approved city or public art program. Developers may choose to combine an art installation with an in-lieu fee to meet the one percent (1%) requirement.
