Program Summary
The Code establishes that construction projects in the city center are subject to a mandatory public art requirement. New constructions or additions of less than one hundred thousand (100,000) square feet of gross floor area shall contribute to the city’s Center District Public Art Fund. New constructions or additions greater than one hundred thousand (100,000) square feet of gross floor area may either contribute the entire amount to the city’s Center District Public Art Fund or may contribute fifty percent (50%) of the fee to the Fund and expend the remaining amount for on-site public art. The amount of the fee shall be based on an amount per square foot adopted by resolution each year, based on the Consumer Price Index in the San Francisco-Oakland-San Jose area for the preceding year.
The remaining development areas of Fremont have a voluntary public art in private development program, found in the Art in Public Places Policy. Private developers interested in providing artwork for public or private places will be given the policy guidelines for reference when submitting a development proposal. The Art Review Board Representative will be available to meet with development review staff and private developers to provide advice and assistance when requested. Private developers may choose to make a cash contribution toward City-planned art in public places projects. This contribution may benefit the developer as a tax-deductible donation.
