Art in Public Places, El Cerrito, California, Municipal Code, Title 15, Chapter 15.07 (2022).

The Code establishes that commercial or industrial projects with project costs over five hundred thousand dollars ($500,000), including projects which have multiple phases in a 12-month period and development projects with new construction of four (4) or more residential dwelling units, including such projects within a single building, structure or mixed use development; within a planned unit development; or within a mixed-unit development, are subject to a mandatory public art requirement, or else pay an in-lieu fee to the Public Art Fund equal to one percent (1%) of the total project cost, up to a maximum amount as established by City Council Resolution.

The requirements do not apply to the following activities:
All public work and governmental agency projects;
Reconstruction of structures which have been damaged by fire, flood, wind, earthquake or other calamity;
Religious, hospital, scientific, charitable organizations, public educational institutions if the project is constructed on property exempt from taxation pursuant to California Revenue and Taxation Code Section 214.
