Program Summary
The Code establishes that all construction or alteration projects within the City are subject to a mandatory public art requirement. This requirement does not apply to the following developments:
- Residential alterations;
- Residential projects in which at least ninety percent (90%) of the dwelling units are restricted to very low, low, or moderate income households;
- Alterations involving less than fifty percent (50%) of the gross floor area of a building;
- Alterations with a construction cost of less than five hundred thousand dollars ($500,000.00);
- Alterations by 501(c)(3) nonprofits organizations, where such organizations do not own the building; and
- Residential development projects of five (5) or fewer units.
Projects may satisfy the requirement by installing on-site public art, the value of which shall be one percent (1%) of construction costs; or one half a percent (0.5%) of construction costs for non-profit organizations, hospitals, and parking facilities. Maintenance and conservation of the artwork will be the responsibility of the property owner. Alternatively, developers may pay an in-lieu fee to the public art fund, the value of which shall be equivalent to the onsite art installation. When the value of the art would be fifty thousand dollars ($50,000.00) or less, it is encouraged, but not required, that a payment be made to the fund.
