Program Summary
The Code/Policy establishes that commercial, industrial, or non-residential portions of mixed-use construction or renovation projects where project costs total more than five hundred thousand dollars ($500,000.00) and development projects involving new construction of four (4) or more residential dwelling units are subject to a mandatory public art requirement. Reconstruction of structures which have been damaged by fire, flood, wind, earthquake, or other calamity; and religious, hospital, scientific, charitable organizations, public educational institutions constructed on property exempt from taxation pursuant to California Revenue and Taxation Code Section 214, are excluded from the requirement.
Projects may satisfy the requirement by installing artwork in a public place on or in the vicinity of the project site as approved by the City Council. The value shall equal or exceed one percent (1%) of the total project cost. Alternatively, developers may pay an in-lieu fee equal to one percent (1%) of the total project cost to the Art in Public Places Fund. This fee shall be paid before the issuance of building permits and applicants shall indicate on their art in public places application that they wish to make an in-lieu contribution.
