Program Summary
The Code establishes that all commercial, industrial, office or other nonresidential development projects with a calculated value of at least one hundred thousand dollars ($100,000.00) for which a building permit is required are subject to a mandatory public art requirement. Reconstruction of buildings that have been damaged by fire, flood, wind, earthquake, or other calamity are excluded from this requirement.
Projects may satisfy the requirement by installing a public artwork onsite or donating an artwork to the City, with a minimum value of one percent (1%) of the project value. If the value of the public artwork approved by the City Council is less than one percent (1%) of the project value, then the difference shall be paid to the Art in Public Places Fund. Maintenance, insurance, and conservation of the artwork is the responsibility of the property owner. The insurance shall be in an amount equal to or greater than the artwork value and shall provide coverage against loss or damage (including vandalism) of the public artwork. Alternatively, developers may contribute an in-lieu art fee in the amount of one and a quarter percent (1.25%) of the project value.
