Program Summary
The Code establishes that all private development projects, including residential projects with more than thirty (30) and exclusive low income housing, are subject to a mandatory public art requirement. Additional exceptions from this requirement can be found in the code section referenced above. The value of the artwork or fee paid is based on the following fee schedule:
- One percent (1%) of construction cost for the first fifteen million dollars ($15,000,000.00) of construction costs;
- Three quarters of a percent (0.75%) of construction costs between fifteen million dollars ($15,000,000.00) and twenty-five million dollars ($25,000,000.00); and
- Half a percent (0.5%) of construction costs in excess of twenty-five million dollars ($25,000,000.00).
Projects may satisfy the requirement in one of two ways:
- Installation of artwork on-site of which, at least 50% of the minimum allocation shall be invested in works placed on the exterior of the development, with an exception for shopping malls of at least one million (1,000,000) square feet. Works placed in interior locations must be accessible to the public during normal business hours. Maintenance and conservation of the artwork will be the responsibility of project developers; or
- Contribution of an in-lieu fee of equal value to the Art in Public Places Fund.
