Program Summary

The Code establishes that all new developments, including parking structures; residential developments of four (4) units or more; commercial and industrial projects, with a building valuation exceeding two hundred and fifty thousand dollars ($250,000.00) in the aggregate; all exterior and interior modifications and additions of developments, including parking structures, mixed-use, commercial, or industrial buildings; or individual tenant improvements in a commercial or industrial building with a project valuation exceeding two hundred and fifty thousand dollars ($250,000.00) in the aggregate are subject to a mandatory public art requirement. Exclusions and inflation adjustments can be found through the Art in Public Places Program.

Projects may satisfy the requirement by installing city council approved artwork on-site or donating an artwork to the city, the minimum value of which shall be one percent (1%) of development project valuation, not to exceed four hundred and fifty thousand dollars ($450,000.00). Maintenance and conservation of the artwork will be the responsibility of the owner. Alternatively, developers may contribute an in-lieu fee, the value of which shall be one percent (1%) of the development project valuation for nonresidential projects, not to exceed four hundred and fifty thousand dollars ($450,000.00); or one half percent (0.5%) of the development project valuation of residential single-family projects of four (4) or more units, including remodels and additions, not to exceed four hundred and fifty thousand dollars ($450,000.00). A combination of the above contributions is acceptable, subject to the approval of the city council. Fees paid into the art in public places trust fund that are not committed with- in ten (10) years may be returned to the current owner of the development project with all interests actually earned, thereon if a written request for return is filed with the city treasurer during the tenth (10th) year after payment and refund of the fees is approved by the city council.
