Program Summary
The Code establishes a voluntary public art in private development program where private developers or owners seeking to construct or reconstruct commercial structures are encouraged to allocate one percent (1%) of costs, not to exceed two hundred thousand dollars ($200,000.00), to the provision of fine art in conjunction with such commercial structure or donate one percent (1%) of costs to the public art fund.
The code establishes that new developments in the Central Business District and Channel District are subject to a mandatory public art requirement. Projects must contribute three quarters of a percent (0.75%) of the total project development cost, not to exceed two hundred thousand dollars ($200,000.00), to the Public Art Fund, who will use those funds solely for art works in the respective districts that the contribution came from. Payment must be made prior to the issuance of a certificate of occupancy.
