Public Art, Petaluma, California, Zoning Code, Chapter 18 (2022).

The Code establishes that all private construction or reconstruction projects with construction costs of five hundred thousand dollars ($500,000.00) or more in the following zoning districts are subject to a mandatory public art requirement:

Mixed Use (MU1A, MU1B, MU1C, and MU2);

• Commercial 1(C1) and Commercial 2 (C2);
• Industrial (I);
• Business Park (BP);
• Planned Unit District (PUD);
• Planned Community District (PCD), except residential PUD’s and PCD’s, but including mixed-use; and
• T-5 and T-6 Zones.

Projects may satisfy the requirement by installing public artwork on-site or by contributing an in-lieu fee to the Public Art Fund. The value of the artwork or contribution shall be no less than one percent (1%) of the construction costs. Developers may appeal to the City Council if the artwork is found to not comply with the requirement.
