Art In Public Places, Downey, California, Municipal Code, Article VIII, Chapter 10 (2012).

The Code establishes that all construction or reconstruction projects of commercial buildings with a building valuation of five hundred thousand dollars ($500,000.00) or greater; and all residential projects consisting of more than four (4) units with a building valuation of five hundred thousand dollars ($500,000.00) or greater are subject to a mandatory public art requirement.

Projects subject to the ordinance shall include an on-site installation of public art with a minimum value of one percent (1%) of the building valuation and a maximum value of one hundred and fifty thousand dollars ($150,000.00). Maintenance and conservation of the artwork is the responsibility of the property owner. Alternatively, where the installation of art is impractical or inaccessible, developers may satisfy the requirement by making a contribution of the same value as calculated above to the Art in Public Places Fund. Funds not expended in any given year shall be carried over into the next year and shall be used solely for the Art in Public Places Program.
