Program Summary
The Code establishes that all construction, reconstruction, or expansion projects of commercial, industrial, or mixed use buildings are subject to a mandatory public art requirement. Projects may satisfy the requirement by providing a work of art on-site that is easily accessible during normal business hours and clearly visible to the general public. Maintenance and conservation of the artwork will be the responsibility of the property owner. Where the total construction cost is between five hundred thousand dollars ($500,000) and one million dollars ($1,000,000.00), the value shall be equal to or greater than one percent (1%) of the total construction cost. Where the total construction costs are greater than one million dollars ($1,000,000.00), the value shall be equal to or greater than one percent (1%) of the first one million dollars plus one and a half percent (1.5%) of the amount in excess of one million dollars ($1,000,000.00). Alternatively, developers may pay an in-lieu fee to the City’s Fine Art Program, the value of which shall be ninety percent (90%) of the value required by the foregoing fee structure.
