The Code establishes that projects with a building valuation of two hundred and fifty thousand dollars ($250,000.00) or more and that fall into one of the following categories are subject to a mandatory public art requirement:

• New residential projects of three (3) units or more;
• New commercial (including office and retail), industrial, or light industrial use buildings;
• Mixed-use projects;
• Additions to an existing building; or Rehabilitation, renovation, remodeling, or tenant improvement of an existing or shell building.

Exceptions to this requirement can be found in the code referenced above.

Projects may satisfy the requirement by installing a work of public art on the project site or nearby, the value of which shall be at least one percent (1%) of the building valuation. Maintenance and conservation of the artwork will be the responsibility of the site owner. Alternatively, developers may pay an in-lieu fee into the City Public Art Fund equal to one percent (1%) of the building valuation above two hundred and fifty thousand dollars ($250,000.00.) The public art contribution shall be paid by the developer at the time of building permit issuance. With approval, developers may install a work of public art on the development project site with a value lower than the required fee and make an in-lieu contribution for the balance to the City Public Art Fund.
