Program Summary
The Code establishes that all new commercial and industrial-use construction projects over fifteen thousand (15,000) square feet of gross floor area; and remodel, repair, or reconstruction of existing commercial and industrial properties, interior or exterior, where the building permit value exceeds one hundred thousand dollars ($100,000.00), excluding landscaping and “acts of God,” are subject to a mandatory public art requirement. The following projects are excluded from the requirement:
- Remodel, repair, or reconstruction of existing commercial and industrial properties which constitutes less than one hundred thousand dollars ($100,000.00) of building permit value;
- Residential subdivisions and developments;
- Low-income housing; and
- Construction, remodel, repair, or reconstruction of structures to be occupied by a nonprofit, social service agency or institution.
Projects may satisfy the requirement by installing an artwork in a public place on or in the vicinity of the project site, as approved by the city, with a value equal to at least one percent (1%) of the total project valuation. Maintenance and conservation of the artwork will be the responsibility of the holder of the certificate of occupancy of the property. Alternatively, developers may satisfy the requirement by contributing an in-lieu fee equal to nine-tenths of a percent (0.9%) of the total project valuation to the Art in Public Places Fund.
